Applicable law

The law governing the accessibility measures to be implemented by businesses is the Law of 8 March 2023 on accessibility requirements for products and services. This transposes a European directive.

With the law coming into force on 28 June 2025, companies are required to comply with the new accessibility requirements. Consequently, and in order to limit the costs associated with compliance, it is recommended that accessibility be taken into account from the design stage of any economic project.

What is the scope of the law?

Products (hardware and software running on it):

  • consumer IT equipment such as computers, smartphones and tablets and their respective operating systems
  • payment terminals, check-in kiosks or ticket vending machines – excluding those on board of means of transport
  • televisions connected to the internet (smart TVs) or equipment providing access to audiovisual services
  • e-readers.

Services:

  • electronic communications services, including, for example, telephone and internet services
  • access to audiovisual media services (video on demand, catch-up services, etc.)
  • pre-recorded temporary media (audio and/or video) available on the internet or via an app, which are not considered archives
  • services related to passenger transport by air, bus, train and boat (including their websites and mobile apps), except as provided by law
  • e-banking, online payment and electronic money platforms
  • e-books
  • e-commerce
  • the European emergency number 112 and other national emergency numbers.

Who is affected?

Private sector economic operators, in particular

  • manufacturers, agents (representatives), importers and distributors of the products listed and
  • providers of the services mentioned.

All sizes of businesses are affected, including micro-enterprises, which, however, benefit from certain exemptions.

Certain public sector bodies are also affected if they offer services such as passenger transport, access to an electronic network or the reception of emergency calls from citizens.

What are the penalties?

The OSAPS may impose an administrative fine on any economic operator who:

  • refuses to provide the documents, information or other details requested in the context of market surveillance and service compliance
  • obstructs the exercise of market surveillance and service compliance
  • fails to comply with its decisions on the compliance of products and services.

Criminal fines may also be imposed by the competent courts.

Where a product or service is non-compliant, the OSAPS may decide on all appropriate measures to restrict or prohibit the product or service from being made available on the market or to ensure its withdrawal from the Luxembourg market.
