The Law of 8 March 2023 on accessibility requirements for products and services expressly applies to ‘consumer banking services’, which it defines as:
the provision of the following banking and financial services to consumers:
- credit agreements: consumer credit agreements referred to in Book 2, Title 2, Chapter 4 of the Consumer Code and mortgage credit agreements referred to in Book 2, Title 2, Chapter 6 of the said code
- electronic money as defined in Article 1(29) of the amended Law of 10 November 2009 on payment services
- payment services: any activity carried out on a professional basis listed in the Annex to the amended Law of 10 November 2009 on payment services
- the services defined in points 1, 2, 4 and 5 of Section A and points 1, 2, 4 and 5 of Section C of Annex II to the amended Law of 5 April 1993 on the financial sector
- services related to payment accounts defined in Article 1(26) of the Law of 13 June 2017 on payment accounts
The OSAPS works with the banking sector, disability associations, the banking supervisory authority (CSSF) and the Consumer Protection Directorate to implement solutions that meet accessibility needs.
Insurance
Insurance companies are covered by the law as providers of electronic commerce services, which it defines as ‘services provided via websites or integrated into mobile devices, electronically and at the individual request of a consumer, with a view to concluding a consumer contract’.
This includes, in particular, the provision of information in the pre-contractual phase, the consultation or editing of contracts and the online reporting of claims.
