Distributor
The distributor's obligations are detailed in Article 12 of the law.
Summary of obligations
Distributors' obligations
- Verify compliance: Verify that products comply with the law before selling them.
- Provide information: Ensure that products are accompanied by easy-to-understand instructions and safety information.
- Monitor products: Ensure that products remain accessible when stored or transported.
- Resolve issues: If they discover a product that does not comply with the rules, they must take steps to resolve the issue and inform the parties concerned.
A distributor is considered a manufacturer and, when placing a product on the market under its own name or trademark or modifying a product already on the market in such a way that compliance with the requirements of this law may be compromised, is subject to the obligations incumbent on the manufacturer.
