The obligations of the manufacturer and its representative are detailed in Articles 9 and 10 et seq. of the law.

Obligations of manufacturers

  • Product design: Ensure that products meet several accessibility criteria.
  • Assessment and documentation: Verify that products comply with EAA rules and keep documentation proving this.
  • CE marking: Once the product complies with the requirements, affix the CE marking to the product to show that it meets EU standards. The CE marking indicates that the product complies with European standards for accessibility, safety, health and environmental protection.
  • Providing information: Ensure that labels, instructions, packaging, etc. contain clear information that everyone can understand.
  • Monitoring products: Keep an eye on products after they are sold to ensure that they remain accessible and to resolve any issues that may arise.

Authorised agents or representatives

The manufacturer may appoint an agent by written mandate.

The obligations relating to design, assessment and preparation of technical documentation, as well as marking, may not be part of their mandate.

The authorised representative shall perform the tasks specified in the mandate received from the manufacturer. The mandate shall at least authorise the authorised representative to:

  • keep the EU declaration of conformity and technical documentation available for five years
  • communicate all information and documents necessary to demonstrate the conformity of the product
  • cooperate with the OSAPS on any corrective measures.
