Summary of obligations

Obligations of representatives

The manufacturer may appoint an authorised representative by means of a written mandate.

The obligations relating to design, assessment and preparation of technical documentation, as well as marking, may not be included in the mandate.

The authorised representative shall perform the tasks specified in the mandate received from the manufacturer. The mandate shall at least authorise the authorised representative to:

• keep the EU declaration of conformity and technical documentation available for five years
• communicate all information and documents necessary to demonstrate the conformity of the product
• cooperate with the OSAPS in any corrective measures.

For information, the obligations of the manufacturer:

• Product design: Ensure that products meet several accessibility criteria.
• Assessment and documentation: Verify that products comply with EAA rules and keep documents proving this.
• CE marking: Once the product complies with the requirements, affix the CE marking to the product to show that it meets EU standards. The CE marking indicates that the product complies with European standards for accessibility, safety, health and environmental protection.
• Providing information: Ensure that labels, instructions, packaging, etc. contain clear information that everyone can understand.
• Monitor products: Keep an eye on products after they are sold to ensure they remain accessible and resolve any issues.
